Agreement to these terms
These Terms of Use (“Terms”) govern your use of the websites operated by LINKA Labs, LLC (“LINKA,” “we,” “us”), including linkafleets.com, linkalock.com and docs.linkalock.com, and any content, forms, downloads and documentation on them (the “Sites”). By using the Sites, you agree to these Terms. If you use the Sites on behalf of a company, you agree on its behalf. If you do not agree, do not use the Sites.
1. What these Terms do not cover
Purchases and subscriptions of LINKA hardware, FleetView, the Operator App, our API, Mobile SDK and related services are governed by the Master Services Agreement, order form, or other written agreement between LINKA and the customer. The Go Access App is governed by the Go Access App Terms of Use. If those agreements conflict with these Terms, those agreements control.
2. Use of the Sites
You may use the Sites to learn about LINKA, contact us, book demos, download materials we make available, and read our developer documentation. You agree not to:
- break the law or infringe anyone’s rights while using the Sites;
- try to gain unauthorized access to the Sites, our systems, devices or other users’ accounts;
- interfere with the Sites’ operation, including by introducing malware or overloading them;
- scrape, crawl or harvest content or data by automated means, except search engine indexing that follows our robots.txt;
- reverse engineer any software made available through the Sites, except where the law allows despite this restriction;
- submit false information or impersonate someone else in our forms; or
- use the Sites or our materials to build a competing product.
3. Accounts
Some areas, such as FleetView sign-in or developer resources, require an account. Keep your credentials confidential and tell us promptly at support@linkafleets.com if you suspect unauthorized use. You are responsible for activity under your account.
4. Intellectual property
The Sites and their content, including text, graphics, photos, videos, logos, product names, spec sheets, documentation and software, are owned by LINKA or its licensors and are protected by intellectual property laws. LINKA, LINKA Fleets, LEO, FleetView, Go Access and related logos are trademarks of LINKA Labs, LLC. We grant you a limited, revocable, non-exclusive, non-transferable license to view and use the Sites for your internal business evaluation of LINKA. You may download and share spec sheets and marketing materials in unmodified form. All other rights are reserved.
5. Developer documentation
Documentation on docs.linkalock.com is provided to help customers and partners integrate with LINKA. Use of our API, Mobile SDK, webhooks and GBFS feeds requires a separate agreement and keys issued by LINKA, and is subject to our API and SDK terms.
6. Feedback and submissions
If you send us ideas, suggestions or feedback, you agree we may use them without obligation to you. Do not send confidential information through our public forms unless we have a confidentiality agreement in place.
7. Product information and statements
We work to keep product descriptions, specifications, case studies and savings figures accurate, but they are provided for general information. Results depend on each customer’s operations. Specifications, features and availability may change without notice. Nothing on the Sites is an offer to sell or a binding quote; pricing and terms are set only in a signed order or agreement.
8. Third-party links and tools
The Sites may link to or embed third-party websites and tools, such as scheduling, maps, video and app stores. We do not control them and are not responsible for their content or practices. Your use of them is subject to their terms and privacy policies.
9. Privacy
Our Privacy Policy and Cookie Policy explain how we handle personal information collected through the Sites.
10. Disclaimer
THE SITES AND THEIR CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT THE LAW ALLOWS, LINKA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITES WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS.
11. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, LINKA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SITES. LINKA’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SITES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow these limits, so they may not apply to you.
12. Indemnity
You agree to defend and indemnify LINKA and its members, officers, employees and agents against claims, losses and costs (including reasonable attorneys’ fees) arising from your misuse of the Sites or your breach of these Terms.
13. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Sites will be brought exclusively in the state or federal courts located in Wyoming, and you and LINKA consent to their jurisdiction. If you are a consumer in the EEA or UK, you also keep the protection of the mandatory laws of your country and may bring claims in your local courts.
14. Export and sanctions
You may not use or download materials from the Sites in violation of U.S. or other applicable export control or sanctions laws.
15. Changes and termination
We may update these Terms by posting a new version with a new “Last updated” date. Continued use of the Sites after a change means you accept it. We may suspend or end your access to the Sites at any time if you breach these Terms.
16. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. These Terms are the entire agreement between you and LINKA about the Sites.
